Terms of service

Allure Bay Spa | Effective September 7, 2026 | Last updated September 7, 2026

These Terms of Service ("Terms") govern your access to and use of allurebayspa.com and any related pages, forms, communications, appointment requests, and services offered by Allure Bay Spa (collectively, the "Services"). By using the website, requesting an appointment, or purchasing a spa service, you agree to these Terms. If you do not agree, do not use the Services.

1. About Allure Bay Spa

Allure Bay Spa is a skincare and facial spa located at 877 W Fremont Ave, Suite D-1, Sunnyvale, CA 94087. You may contact us at support@allurebayspa.com or (408) 604-5087.

2. Eligibility and Acceptable Use

You must be at least 18 years old to make a booking or enter into a purchase. A parent or legal guardian must make arrangements for any client under 18 and may be required to remain present and sign consent forms. You agree to provide accurate information and not misuse the website, interfere with its operation, attempt unauthorized access, introduce malicious code, scrape content at scale, impersonate another person, or use the Services unlawfully.

3. Appointments and Confirmation

Submitting an online request does not guarantee an appointment. An appointment is confirmed only after Allure Bay Spa accepts the request and sends a confirmation or confirms it by phone, text, or email. Service availability, treatment duration, assigned provider, and prices may change. Please verify the final details when your appointment is confirmed.

4. Cancellations, Rescheduling, No-Shows, and Late Arrivals

Please contact us promptly if you need to cancel or reschedule. Any cancellation, deposit, no-show, or late-arrival terms presented during booking or in your appointment confirmation will apply to that appointment. If no specific fee or deadline was disclosed when you booked, these Terms do not create a separate fixed cancellation fee. Late arrival may shorten the treatment so later appointments can begin on time. We may reschedule or cancel an appointment because of staffing, safety, equipment, weather, emergencies, or other operational needs.

5. Prices and Payment

Website prices may be starting prices and may vary based on customization, add-ons, consultation findings, or service changes. Applicable taxes, gratuities, deposits, and other charges will be disclosed when reasonably practicable. You authorize us and our payment processors to charge the payment method you provide for approved purchases, deposits, or charges disclosed at booking. We may correct pricing or description errors before providing a service. Unless required by law or otherwise stated in writing, completed personal services are not refundable. This does not limit any rights that cannot legally be waived.

6. Treatment Consultation, Consent, and Safety

Spa and skincare treatments can produce different results for different people and may involve temporary redness, irritation, sensitivity, swelling, bruising, dryness, peeling, discomfort, or other reactions. Before treatment, you must disclose relevant allergies, medications, skin conditions, pregnancy or nursing status, recent procedures, infections, sensitivities, and other information requested by your provider. You must follow preparation and aftercare instructions. We may refuse, modify, or stop a treatment when we reasonably believe it is unsafe, inappropriate, outside our scope, or not in your best interest.

7. No Medical Advice or Guaranteed Results

Website content and spa consultations are for general educational and cosmetic-service purposes. They are not medical advice, diagnosis, or treatment and do not replace care from a licensed physician or other qualified medical professional. Seek medical advice for health concerns, severe reactions, or questions about whether a treatment is appropriate for you. Results vary, and we do not guarantee a particular result, duration, or outcome.

8. Photos, Reviews, and User Content

If you submit a review, testimonial, photograph, comment, or other content, you represent that you have the right to do so and that it is accurate and lawful. Unless a separate written release says otherwise, we will not use identifiable before-and-after or treatment photographs for marketing without your consent. When you voluntarily submit content for public or promotional use, you grant Allure Bay Spa a nonexclusive, worldwide, royalty-free license to use, reproduce, display, and adapt that content for the purpose you authorized. You may withdraw future marketing permission by contacting us, but withdrawal does not require removal of materials already lawfully produced or distributed where removal is not reasonably practicable.

9. Email and Text Messages

If you provide your contact details, we may send transactional messages about appointments, purchases, account security, and customer service. If you separately consent to marketing, we may also send promotional email or SMS messages. Consent to marketing is not a condition of purchase. Message frequency varies. Message and data rates may apply. You may unsubscribe from email using the link in the message and may opt out of marketing texts by replying STOP or by contacting us. Reply HELP for help where supported. Carriers are not liable for delayed or undelivered messages. We may send one message confirming an opt-out request when permitted by law.

10. Intellectual Property

The website and its text, graphics, branding, photographs, layout, design, and other content are owned by Allure Bay Spa or used with permission and are protected by intellectual property laws. We give you a limited, revocable, nontransferable license to access the website for personal, noncommercial use. No other rights are granted.

11. Third-Party Services and Links

The Services may connect to third-party booking, payment, maps, social media, analytics, advertising, or communication providers. Their services and privacy practices are governed by their own terms. We are not responsible for third-party sites or services, but this provision does not limit responsibility imposed on us by applicable law.

12. Website Availability and Disclaimer

We may change, suspend, or discontinue website features at any time. To the fullest extent permitted by law, the website and its content are provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not promise that the website will always be available, secure, accurate, or error-free. Nothing in these Terms excludes warranties or protections that cannot legally be excluded.

13. Limitation of Liability

To the fullest extent permitted by law, Allure Bay Spa and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, or goodwill arising from use of the website. Our total liability for a website-related claim will not exceed the greater of $100 or the amount you paid us for the specific service giving rise to the claim during the six months before the event. These limits do not apply to liability that cannot legally be limited, including liability for fraud, willful misconduct, or personal injury caused by negligence where applicable law prohibits limitation.

14. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold Allure Bay Spa harmless from third-party claims and reasonable costs arising from your unlawful misuse of the website, your violation of these Terms, or content you submit. This does not require you to indemnify us for our own negligence or unlawful conduct.

15. Governing Law and Disputes

California law governs these Terms without regard to conflict-of-law rules. Any court proceeding relating to these Terms or the Services must be brought in a state or federal court with jurisdiction in Santa Clara County, California, unless applicable consumer law permits you to bring a claim elsewhere. Before filing a claim, each party agrees to make a good-faith effort to resolve the issue by contacting the other party. Nothing here prevents either party from seeking appropriate relief in small claims court or from reporting a matter to a government agency.

16. Changes and General Terms

We may update these Terms by posting a revised version and changing the effective or last-updated date. Changes apply prospectively unless the law allows otherwise. If a provision is unenforceable, it will be narrowed or removed only as necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. These Terms, together with any treatment consent, booking disclosure, or written policy presented for a specific service, form the agreement concerning the Services. If a specific signed treatment consent conflicts with these website Terms regarding that treatment, the signed treatment consent controls.
